Terms of Use
The short version: the app is free to use with one list. A single optional payment unlocks everything else, for good. Your lists are yours. The app is provided as it is, and refunds go through Apple.
These Terms of Use (“Terms”) apply to the Crossed Off app for iPhone and iPad, its widget and its Lock Screen timer (together, “the app”). By downloading or using the app you agree to these Terms. If you do not agree, please do not use the app.
1. Apple’s standard license
The app is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms add to the Standard EULA. If the two conflict, the Standard EULA wins to the extent required by Apple.
Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
2. Using the app
You may use the app on any Apple device you own or control, as permitted by the App Store’s usage rules. Please don’t copy, modify, reverse-engineer, resell or redistribute the app, except where the law allows you to regardless of this restriction.
3. Free and paid features
The app is free to download. The free version includes one list with unlimited items, the fill timer, estimates, and ruled paper with navy ink.
An optional one-time in-app purchase, Unlock Everything, adds every paper and ink colour, unlimited lists, the ring timer, focus stats, and the Lock Screen timer and Home Screen widget. The price is shown in the app before you buy and may vary by country.
- It is not a subscription. You pay once. There are no recurring charges.
- It is tied to your Apple ID. Tap “restore a previous purchase” in the app to unlock it again on another device or after reinstalling.
- Payment is processed by Apple. Your purchase is also subject to the Apple Media Services Terms and Conditions.
- Refunds are handled by Apple. We cannot issue refunds directly. You can request one at reportaproblem.apple.com. If a refund is granted, the paid features will lock again.
- Family Sharing is not available for this purchase.
We may add features to the free or paid versions over time. We will not take away a paid feature you have already bought in an update, unless we are required to by law or by Apple, or the feature stops working because of a change in iOS that we cannot reasonably work around.
4. Your content
Everything you write in the app belongs to you. It is stored only on your device, and we never receive a copy of it. You are responsible for keeping your own backups, for example with iCloud Backup. We are not responsible for content lost because a device was lost, reset or damaged, or because the app was deleted.
5. Privacy
The app does not collect personal data. See the Privacy Policy for details.
6. Not professional advice
The app is a productivity tool. Timers, estimates and stats are there to help you plan, and are not medical, psychological or professional advice. Please do not rely on the app for anything where a missed reminder or an inaccurate timer could cause harm.
7. No warranty
To the fullest extent the law allows, the app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not promise the app will be error-free or uninterrupted. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you, as described in the Standard EULA.
8. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or productivity, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim. Some places do not allow these limits, so they may not all apply to you. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date above. If a change is significant, we will mention it in the App Store release notes. Continuing to use the app after a change means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. If you live in the European Union or the United Kingdom, you also keep the protection of the mandatory consumer laws of the country where you live.
