These Terms govern your use of the Baby Days iOS app ("the App"), provided by Baby Days ("we," "us," "our"). By downloading or using the App, you agree to these Terms. If you don't agree, please don't use the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for personal and non-commercial use, subject to Apple's Licensed Application End User License Agreement, which is incorporated by reference.
You acknowledge that these Terms are between you and us, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the App's purchase price to you (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
The App does not require you to create an account on a Baby Days server. The App stores entries, audio, photos, milestones, and child profiles locally on your device and (if you have iCloud enabled) syncs them to your private CloudKit container. You own all of the content you create in the App. We claim no rights to your recordings, photos, transcripts, or any other content you produce.

Baby Days is a memory-keeping tool. The milestones and developmental prompts inside the App are general parenting references and are not medical, psychological, or developmental advice. For any concern about your child's health or development, consult a qualified professional.
Use of the App is also governed by the Privacy Policy, which describes what data the App handles and how. The short version: audio stays on your device, there are no analytics or tracking, and I have no copy of your content.
We may release updates that fix bugs, add features, or change behavior. We may also discontinue or modify features at any time. We will not, however, take away the Pro features you've purchased without offering a reasonable alternative.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that data syncing through your iCloud account will be free of loss or corruption.
Baby Days relies on services controlled by Apple (StoreKit, iCloud, Speech Recognition). We are not responsible for outages, data loss, or behavior caused by those services.
To the maximum extent permitted by law, in no event will we be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the App. Our total liability for any direct damages will not exceed the amount you paid for the App in the twelve months before the claim arose, or US $50, whichever is greater.
You can stop using the App at any time by deleting it. We may suspend your access if you materially breach these Terms. Sections that by their nature should survive termination (Privacy, IP ownership, Disclaimers, Limitation of Liability, Governing Law) will survive.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of the App will be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction there. If you reside in a jurisdiction whose law gives you mandatory consumer rights, nothing in this section overrides those rights.
If we change these Terms in a way that materially affects your rights, we'll update the "Last updated" date and, where appropriate, surface a notice in the App. Continued use of the App after a change means you've accepted the updated Terms.
